I GENERAL ACTIVITIES
1.1 The discharge of firearms is prohibited.
1.2 Littering is prohibited.
1.3 Fireworks and firecrackers are prohibited.
1.4 All outdoor burning of any kind is prohibited within the survey of
Shelter Bay. (11/17/99)
1.5
Shelter Bay members are responsible to insure that family, tenants,
agents and guests comply with the Protective Covenants and the
Community General Rules and Regulations.
1.6 Shelter Bay members who
may be responsible for damage to Shelter Bay community property are
liable for costs of repair or replacement.
1.7 Solicitation of
Shelter Bay dwellers is prohibited except by mail or invited contact.
This applies to commercial solicitation but not to legal collection of
debts.
1.8 Use of the Shelter Bay Community mailing list may be authorized by
the Board of Directors.
1.9
Dogs of members' or tenants' premises are to be leashed at all times.
Loose animals may be impounded. Dog owners are responsible for cleaning
up feces left by their dog(s). (2/2/02). No single household may have
more than 3 dogs without the written permission of the Committee
responsible. (8/17/05)
1.10 Shelter Bay members who rent or lease
their homes or docks shall obtain and complete a rental agreement form
from the community office.
1.11 Shelter Bay members are responsible
for maintenance of their lots: mowing, clearing of overgrown brush and
dead trees, drainage and ditching. Any lot that the manager deems
neglected and in need of mowing will be mowed by the community and the
owner will be billed the customary charge. (Res. 07-01, 4/20/07)
1.12
During times of snowfall, skiing or sledding on the main streets of
Shelter Bay is forbidden for safety reasons. The golf course greens are
off limits during freezing weather as the grass can be severely damaged
when frozen.
1.13a Individual Garage Sales require a manager-issued
permit and must be held within 3 months of moving in or moving out.

1.13b Community-wide garage sales may be held with the approval of the

1.14
Consistent with the Declaration of Protective Covenants, Article 4,
Section 9, community facility users shall conduct themselves in an
orderly manner so that community members are not disturbed in their
residences. Use of sound-emitting electronic equipment including
electrical speakers, radio, phonographs, television, or other such
equipment shall be at a reasonable volume that is not audible beyond
the vicinity of the facility area, so as not to disturb community
members in their residences. (6/15/05)
1.15 The Board of Directors
will approve, maintain, and post a current Schedule of Fees for
applicable permits, rents, leases, and other fees and deposits
necessary for the conduct of business with the community. (Res. 07-01,

1.16 For purposes of all mail or other delivery to Shelter Bay Community, Inc. its board, committees or staff, in their official capacity, the official address to which all such mail or delivery is to be addressed is: 1000 Shoshone Drive, La Conner, WA 98257. (Res. 08-03 am, 3/19/08)
1.17 No member is considered a "member in good standing" if
any dues, assessments or other charges remain due and payable to the
corporation in excess of 60 days. (Res. 07-01, 4/20/07)
II. HARBOR AND PRIVATE DOCKS. (6/15/05)
2.1 Refueling of vessels by hoses from any shoreline facility is
prohibited.
2.2 Use of the launching ramp is at boat owner’s risk. Access is by
key available at the office.
2.3
Private dock renters: When an owner rents his dock, the owner shall
provide the Shelter Bay office with a copy of a "Tenant Information"
form for renters (available at the office) and purchase gate cards for
entrance to the Community. Dock renters will be expected to follow all
other Rules and Regulations and Covenants of the Community.
2.4
Sailboats should use auxiliary power when entering and leaving the
marina. Sailboats do not have right-of-way over another vessel when
under sail.
2.5 The Marina is owned and operated by Shelter Bay
Company. For further information refer to the Shelter Bay Company
Marina Policies and Rules and Regulations, a copy of which is available
in the business office.
2.6 Emergencies
- Fire: Call 911 first, describing the emergency and dock and slip
number.

If it can be done SAFELY, use a portable fire extinguisher and boat
fire extinguisher on the fire. DON'T PUT YOURSELF AT RISK! Call the
Harbormaster.
- Boats in danger of sinking: Call the Harbormaster and/or Marina
Administrator.
- Oil spills or other environmental emergency-Call the Harbormaster
and/or the Marina Administrator.
- Children under 12 years of age are not permitted on marina docks
without supervision of a parent or other responsible adult.
2.7 Swimming in the marina is prohibited.
2.8
Non-resident marina tenants, their agents and/or invitees shall obtain
a parking pass from Shelter Bay Community office. They shall be
prominently displayed in the vehicle at all times while in Shelter Bay
Community.
2.9 Non-resident marina tenants, their agents and/or
invitees shall obtain gate cards from Shelter Bay Community office and
pay a refundable damage and gate card deposit as established in the
Schedule of Fees. The gate card is to be shown to the patrol staff when
on duty at the Community gate. Upon return of issued cards, the deposit
will be refunded if there are no outstanding claims against it. (Res.

III. CLUBHOUSE (Res. 07-01, 4/20/07)
3.1
In ALL cases a "Rental or Facility Use Agreement" form with the user's
signature shall be completed. The scheduling of Board and Shelter Bay
Community/Company official meetings are exempt from this provision. The
Social/Recreation Committee may modify or waive damage deposits. The

3.2 Persons who are renters of record of
residential property in Shelter Bay shall be accorded the same
privileges as Regular and Associate Members with regard to this
section. (Res. 07-01, 4/20/07; Res. 08-14, 8/20/08)
3.3
Terms and conditions include in each case: all facilities are used at
"own risk" and Shelter Bay Community, Inc. shall not be liable for
any
injuries incurred by member, family or guests. The Community shall be
reimbursed for all costs of cleaning and repair of property damage.
Facilities will be left in the same condition as found. No animals are
allowed in the Clubhouse, except documented/certified service dogs.
Rental or use of the Clubhouse does not include exclusive use of the
swimming pools, tennis courts, golf course, playground, BBQ areas and
other recreational facilities. (See Section IV Parks and Barbeque

3.4 Shelter Bay members may rent the clubhouse for: their
own use; private parties they are hosting; or for a group or
association of which they are members and will be in attendance. Such
groups or associations shall meet criteria specified in 3.5 and 3.6. (Res. 07-01, 4/20/07)
3.5
Priority for use of the Clubhouse shall be as follows: 1) official and
social activities of the community; 2) Shelter Bay Yacht Club
activities; 3) activities sponsored by Shelter Bay Members; and 4)
other activities approved by the Social and Recreation Committee. The
Community Office may change schedules with the mutual agreement of the
parties involved. (Res. 07-01, 4/20/07)
3.6 Groups or organizations intending to use the
Clubhouse for political, commercial, or fund raising purposes are not
allowed. However, the Social and Recreation Committee may approve
classes and events which, at their discretion, are of value to the
membership and that are paid for by funds allotted to the Committee or
are funded by the participants.
3.7 Supplies and linens belonging
to the Community or the Yacht Club are not available for use by the
Clubhouse renter or caterer. Clubhouse renters are responsible for
notifying hired caterers of these and other items, including the
limitation of the kitchen and its equipment and instruction on use of
the fireplace. The Clubhouse renter is responsible for providing
firewood. Setup and cleanup is also the Clubhouse renter’s
responsibility and the Clubhouse renter will be charged for repairs,
missing or damaged Clubhouse items and clean-up costs that exceed the
damage deposit. The Community is not responsible for any Clubhouse
renter or Clubhouse renter sponsored organization’s items lost or
left

3.8 The Clubhouse renter will be given
instructions by the office on use and operation of lights, heaters and
cleaning equipment. Smoking is not allowed in the clubhouse. All
outside doors to remain unlocked while Clubhouse is occupied. The use
of glitter is not allowed in the Clubhouse. Only dripless candles in
secure holders may be used. (Res. 07-01, 4/20/07)
3.9 Clubhouse renters are required to
remove all trash, refuse and garbage. The Office will provide
information regarding cleanup and disposal. (Res. 07-01, 4/20/07)
3.10 Rental fees and
deposits will be in accordance with the Schedule of Fees as approved by
the Board of Directors. Damage deposits are refundable upon approval of
Manager. (Res. 07-01, 4/20/07)
3.11 Loan of tables and chairs outside of Shelter Bay is prohibited. (Res. 07-01, 4/20/07)
3.12 Rules for use of piano: (Res. 07-01, 4/20/07)
- Do not put anything on top of the piano or on the piano cover.
- Do not allow children to play the piano without adult supervision.
- The piano will be checked before and after use and if determined no
damage has occurred, the damage deposit will be refunded.
3.13 Maximum occupancy is 150. (Res. 07-01, 4/20/07)
3.14
A directional sign may be placed at each successive street change off
Shelter Bay Drive and at the location of the event, during the time of
the event and must be removed within 48 hours after the event. No signs
of the event shall be attached to street sign posts, fencing and fence
posts, utility poles, the Shelter Bay sign posts or in the planter box
at Pioneer Parkway and Shelter Bay Drive intersection and on any other
type of community sign/post. (Res. 07-01, 4/20/07)
3.15 Exceptions to any of these provisions require Social and
Recreation Committee approval. (Res. 07-01, 4/20/07)
IV. PARKS AND BARBEQUE AREAS (Title Only-Res.
07-01, 4/20/07)
4.1
Shelter Bay members may reserve the BBQ areas at Rainbow Park and the
marina for their own use, private parties that they are hosting, or for
a group or association of which they are members and will be in
attendance. Groups or organizations intending to use the parks and
barbeque areas for political, commercial, or fund raising purposes are
not allowed. (Res. 07-01, 4/20/07)
4.2 Persons who are renters of
record of residential property in Shelter Bay shall be accorded the

4.3 In all cases of exclusive use a
"Rental or Facility Use Agreement" form shall be completed. A copy
will
be issued to the applicant, which must be displayed during the
scheduled use of the facility. Terms and conditions include: all
facilities are used at "own risk" and Shelter Bay Community, Inc. shall
not be liable for any injuries or adverse actions by member, family or
guests. The Community shall be reimbursed for all costs incurred in
cleaning and/or repair of property. (Res. 07-01, 4/20/07)
4.4 No
signs, balloons, or announcements of the event shall be attached to
street sign posts, fencing and fence posts, utility poles, the Shelter
Bay Drive sign posts or in the planter box at Pioneer Parkway and
Shelter Bay Drive intersection and on any other type of community
sign/post. A directional sign may be placed at each successive street
change off Shelter Bay Drive during the time of event. (11/17/01).
4.5 Martha's Beach will be opened at 8:00 a.m. and closed at 7:00 p.m. from October 1st to March 31st and 9:45 p.m. from April 1st to September 30th. Overnight use of the beach property is prohibited. (Res. 08-08, 4/16/08)
4.6
Only fires in the firepits at Martha's Beach and the permanent BBQ
facility at Rainbow Park are allowed. (No open fires are allowed during
burn bans. Use of charcoal briquettes and/or propane in barbeques is
allowed during a burn ban.). Fires must be attended at all times and
extinguished before leaving. Gas or charcoal barbecuing at home or the
community barbecue facilities is not considered as outdoor burning.

4.7 Removal of driftwood from Martha's Beach is prohibited except as
authorized by the manager.
4.8 Trash from the use of the above facilities shall be placed in
provided receptacles only.
4.9 Dogs shall not be allowed to run loose, but shall be leashed or
confined.
4.10
Operation of vehicles and motorcycles on Martha's Beach, other than
transportation to and from, is prohibited. (Res. 07-01, 4/20/07)
4.11 Shelter Bay Community, Inc. is not responsible for any lost items.
4.12 Use of a generator is prohibited, unless its use is approved in
advance by the manager. (Res. 07-01, 4/20/07)
V. RECREATIONAL FACILITIES
5.1 Pool Regulations (Res. 07-01, 4/20/07)
- Swimmers will shower before entering pool.
- No one with skin infection or bandages will be allowed in the pool.
- Children not potty-trained must wear clean diapers, plastic or
rubber pants plus bathing suit when in the pool.
- "Cutoffs" or frayed swimsuits are not allowed in the pool.
- No food, drinks, smoking or gum chewing are allowed in the pool
enclosures or in bathrooms or dressing rooms.
- Running or rough play is not allowed.
- Flotation equipment is not allowed.

5.2 Pool Usage (Res. 07-01, 4/20/07, Res. 07-05 am, 5/16/07)
- Lower Pool: Pool attendant must be present, and non-swimmers and children under 10 years of age must be accompanied by an adult.
- Upper Pool: For resident and guest adult swimmers (21 and over).
5.3 Golf Course Regulations (Res. 07-01, 4/20/07)
- Only golfers are allowed on golf course.
- Children under 10 years of age must be accompanied by an adult.
5.4 Tennis Court Regulations (Res. 07-01, 4/20/07, Res. 07-05 am, 5/16/07)
- Only tennis players are allowed on the tennis courts.
- Players must wear tennis shoes that will not leave scuffmarks.
- Lower courts are reserved for adult doubles play each morning until
noon.
- One hour time limit is imposed if other players are waiting.
- Players must ensure courts are securely locked on leaving the
premises.
- Children under 10 years of age must be accompanied by an adult.
5.5
Pets, skateboards, roller skates, bicycles, Frisbees or similar equipment are not allowed on the golf course, tennis courts or in the swimming pool areas. Skateboards are not allowed to be
used around the Clubhouse and on the adjacent parking areas; however, skateboards may be
used in other areas designated for the purpose by the manager. (Res. 07-01, 4/20/07; Res.

VI. VEHICLE STORAGE LOT
6.1 No space in the storage lot will be occupied unless and until a
lease or sublease for that space has been executed.
6.2
Vehicles or property parked or stored in the storage lot will be the
property of the lessee who is a member in good standing of Shelter Bay
Community. (4/21/04)
6.3 No noxious or hazardous material will be
stored in the storage lot except that vehicle fuel and heating or
cooking fuel may be stored in vehicle fuel tanks or pressurized fuel
bottles which are connected to vehicle trailer, camper or motor home
systems.
6.4 All property stored in the space shall be parked or
located one foot inside the side boundaries and within the rear and
front boundaries of the space.
6.5 The speed limit within the storage lot is 5 miles per hour.
6.6
Children under 12 years of age are not permitted in the storage lot
except in the immediate presence of a parent or other responsible adult.
6.7 Animals shall be leashed at all times when on the storage lot
premises.
6.8 All covenants and general rules and regulations apply to the
storage lot.
6.9
The name, address and telephone number of the owner is to be
conspicuously displayed on each vehicle, boat or trailer stored in the
lot.
6.10 No structures (sheds, lean-tos, tents) will be erected
in the Storage Lot without written approval of the Lot Committee

6.11 No more than two (2) spaces may be rented by a member without the
written approval of the Lot Committee. (11/16/05)
VII. USE OF ROADS AND VEHICLES
7.1
The motor vehicle laws of the State of Washington shall apply as rules
and regulations with respect to roads within Shelter Bay, therefore,
all motorized vehicles and bicycles will comply with said laws.
7.2
County weight limits and other restrictions apply to all Shelter Bay
roads unless designated otherwise by the Board of Directors.
7.3
Unless otherwise posted, maximum vehicular speed limits within the
boundaries of Shelter Bay Community shall be 25 miles per hour, except
those emergency vehicles as defined and authorized under RCW Chapter
36.37 and Chapter 46.61 shall be exempt from this provision. (5/7/98)
7.4
No prolonged or overnight parking on roads or shoulders will be
permitted within Shelter Bay. Vehicles found so parked after dark that
are an impediment to traffic or a hazard to safety will be towed away
at owner's expense.
7.5 Driving of any motorized vehicle on any
Shelter Bay area other than roads and designated parking areas is
prohibited. This includes sidewalks and walking paths.
7.6 With the
exception of Community vehicles, no prolonged or overnight parking in
the Shelter Bay Clubhouse, Office or Annex parking lots will be allowed
without a valid permit approved by the Manager. Overnight parking, up
to three days maximum, is allowed for boat trailers only in the parking
lot near the boat launch. Regarding parking of contractor vehicles and
equipment, see Article IX, Section 9.19. (Res. 07-01, 4/20/07)
VIII ENTRANCE GATE AND NEIGHBORHOOD WATCH.
8.1
Entrance to Shelter Bay is controlled by an entrance gate, the hours of
which are established by the Board of Directors. (6/15/05).
8.2 Gate
cards may be obtained at the Shelter Bay office. The policy and fee is
established by the Board of Directors. Residents must follow the Board
approved protocol for access through the front gate. (Res. 07-01,
4/20/07)
8.3 Public inspection and safety officials, law enforcement
officers, fire and medical emergency crews and public utility crews
needing access to Shelter Bay will be provided gate cards or other
authorized means of access to the Community. (Res. 07-01, 4/20/07)
8.4
Residents of Shelter Bay are encouraged to organize a neighborhood
watch program in their neighborhood. The Community Office will provide
the name of the employee emergency response team member who will
provide the necessary information. (6/15/05).
IX. CONSTRUCTION (Title-Res. 06-04,
1/18/06)
9.1
Application for a permit is required for new construction, any exterior painting, remodeling, installation of accessory structures (tents, sheds, etc), construction of piers and floats, construction of fences, and paving and driveways. (Res. 06-04, 1/18/06; Res. 07-12, 9/19/07)
9.2 Construction must start
within 90 days of permit approval or review and re-approval by the
Building Committee is required. (Res. 06-04, 1/18/06)
9.4 Extensions
of completion date are not granted automatically. If it appears that
the one-year completion date cannot be met, approval of the Building
Committee must be sought.
9.5 One temporary toilet facility must
be placed at a building site and it must be removed when the house
toilet facilities are operable. (Res. 06-04, 1/18/06)
9.6 Building
site must be cleaned up weekly. Construction debris shall not be buried
on site or deposited in marina dumpsters. (Res. 06-04, 1/18/06)
9.7 Burning of trash on the job site is prohibited. (11/17/99; Res.
06-04, 1/18/06)
9.8
Temporary piling of dirt from excavation or rough grading will be done
in a manner to avoid damage to trees and natural growth. Care must be
exercised to avoid damage to adjacent properties including greenbelts.

9.9 Proper drainage and culverts must be
installed and maintained as to not impede the natural drainage ditches
and their flow. (Res. 06-04, 1/18/06)
9.10 The owner is responsible
for drainage into community ditches and roadways. Ditches are to be
protected from siltation into the community system. A silt fence or
straw bales shall be used to trap silt that runs off the construction
site. (Res. 06-04, 1/18/06)
9.11 Concrete may not be dumped into ditches, roads, neighboring lots,
or green belts.
9.12
Construction hours are limited to 7:30 a.m. to 6:00 p.m. No operation
of machinery is permitted on Saturday or Sunday with out the approval
of the manager. (Res. 06-04, 1/18/06)
9.13 During construction
hours, the builder shall not permit loud radios. Pets brought to a
building site must be leashed or confined. (Res. 06-04, 1/18/06)
9.14
No portion of a fuel tank, heat pump and/or propane tank will be
installed closer than fifteen (15) feet from any street and ten (10)
feet from property lines, and each will be properly screened. (Res.
06-04, 1/18/06)
9.15 If necessary to insure compliance with the
Covenants and Rules and Regulations, the Building Committee upon a
majority vote may authorize a stop work order to be delivered to the
builder at the site with a copy mailed to the lot owner. Work may
recommence with the authorization of the Building Committee. (Res.
06-04, 1/18/06)
9.16 The owner is responsible for obtaining, in a
timely manner, the required inspections as specified by the Building
Committee. (Res. 06-04, 1/18/06)
9.17 The Completion/Damage
deposit will be returned after final inspection and approval by the
Building Committee. (Res. 06-04, 1/18/06)
9.18 Wood roofing of any
sort, including wood shingles and wood shakes, is prohibited in new
construction. If 50% or more of the roof covering of any building is
repaired or replaced, then the entire roof covering must comply with
the requirement for new structures. All roofing materials used for new
structures shall be non-combustible (metal, cement composite, tile) or
shall have a Class A fire resistance rating, certified in accordance
with UL 790 or ASTM E0108 requirements. (Res. 06-07, 2/15/06)
9.19
Contractor vehicles and equipment shall be parked on or immediately
adjacent to the lot under development, and shall not block traffic. No
prolonged or overnight parking of contractor vehicles or equipment will
be allowed in areas other than the development site without express
authorization of the Manager. (Res. 07-01, 4/20/07)
X. SCHEDULE OF FINES
10.1
Any fines levied must be paid within seven (7) days of receipt of the
fine notification. If not paid by the seventh day, the fine will
increase that day and each seven days thereafter, by the amount of the
original fine, until the total accumulated fine is paid, or it is
determined by the Rules Committee that the violation has been
satisfied. Failure to pay a fine within sixty (60) days may result in a

XI. SIGNS
11.1
No sign of any kind may be displayed to public view on any tract,
parcel, or community property without written approval of the committee
responsible, except, lot owners may erect a sign not to exceed two (2)
square feet in area to identify their place of residence. (7/17/02)
11.2
No resident or their agents may post or erect signs of any kind within
the boundary of the Shelter Bay entrance from the Entrance Gate to
Pioneer Park Way. (6/15/05).
11.3 Signs shall be removed if found in violation of the Protective
Covenants or the General Rules & Regulations. (7/17/02)
11.4
Residence "For Sale" signs: One per lot, not to exceed 2' x 2' attached
to the structure or on a post not over 4' high, located in such a
manner as to not obstruct the view of the roadway. The sign may have
one attachment for the name and phone number of the real estate agent
and one informational box No other appendages or information can be
attached by the owner or the real estate company. (7/17/02; Res. 06-12

11.5 "Open House" signs: One standard size realtor
sandwich board may be displayed within the property boundary from 12:00
noon to 6:00 p.m. each Saturday and Sunday. A standard sandwich board
directional sign may be placed at each successive street change off
Shelter Bay Drive during the time of the open house. Open house signs
are not permitted within the boundary of the Shelter Bay entrance from
the Gate to Pioneer Park Way. (6/15/05).
11.6 Vacant Lot "For Sale"
Signs: One sign only which conforms to the size and placement for
residential "For Sale" signs. (7/17/02)
11.7 Contractors signs: One

"Garage Sale" signs: No signs will be approved until the manager has
issued the Garage Sale permit or authorization has been given for a
community-wide garage sale. Signs shall be consistent with Section

House identification signs: Each resident is required to purchase and
post a standard house number sign. The sign is white with blue numbers
and may be purchased from Mortenson Signs (360) 424-5099. It should be

11.10 Decorative or informational
signs: A decorative or information sign will be permitted upon
recommendation by the Board of Directors and/or the Lot Committee.

11.11 Commercial, boat or vehicle "For Sale" signs shall
not be displayed within Shelter Bay Community. (7/17/02; Res. 06-12 am,

11.12 Political yard signs may be displayed for candidates running for political office and/or ballot issues in any election in which all members of the community can be eligible to vote. Political yard signs shall be limited to one sign per candidate and per issue not to exceed 2-feet by 2-feet in size, attached to the structure or on a post not over 4-feet height. If attached to a post, the sign shall be located within the boundaries of the lot and located in such a manner as to not obstruct the view of the roadway. Political yards signs may be posted up to three weeks prior to the election, and must be removed within 48-hours after the election. (Res. 06-12 am, 9/20/06, Res. 07-05 am, 5/16/07)
11.13 Except as otherwise provided, all signs posted in Shelter Bay
shall: (Res. 07-01, 4/20/07)
- be no larger than 12" x 14" and firmly affixed to a stake or post
not over 3' in height

not be attached to street sign posts, fencing or fence posts, utility
poles or posted within the boundary of the Shelter Bay entrance from
the Community Patrol gate to Pioneer Parkway, nor on any other type of
community signpost.
- not placed on any private lot without the owner's permission.
- be removed immediately after the function.

be removed if not in accordance with the above items or found in
violation of the General Rules & Regulations or Protective
Covenants. Permit violations are subject to review by the Rules
Committee and possible sanctions.
- One directional sign may be placed at each successive street change
off Shelter Bay drive and at the function location.
XII. EXTERIOR LIGHTING
12.1 Residential Requirements: (Res. 07-01, 4/20/07; Res. 08-12, 8/20/08)
- Exterior lighting should be low wattage. (Res. 07-01, 4/20/07)
- Motion activated lights should be installed whenever possible.

Spot and floodlights must be shielded to restrict them to the owner’s property. (Res. 08-12, 8/20/08)
- Landscape lighting should be a low voltage system. (Res. 07-01, 4/20/07)

Contact the Lot Committee for recommendations and approval on any
additional lighting. This may eliminate the inconvenience of removing
inappropriate fixtures. (Res. 07-01, 4/20/07)
12.2 Dock, Float and Pier Lighting Requirements: (Res. 07-01, 4/20/07)
- All fixtures to be low level, louvered, low wattage type.
- No floodlighting will be allowed on docks, floats or piers.
