SHELTER BAY MARINA
RULES AND REGULATIONS
Introduction
The
Shelter Bay Marina belongs to the Shelter Bay Community -- in other
words, to all of us. These revised Rules and Regulations are written to
keep our marina safe, in compliance with environmental regulations, and
a place where we can be confident that our boats are secure. The Rules
and Regulations cover everyday marina activities. Lease agreements are
reviewed in Marina Policies.
Environmental regulations are
strict with severe penalties for violations. Careless or unsafe actions
could end in lawsuits. Complying with these Rules and Regulations will
help protect both you and our marina.
These Rules and
Regulations are part of your lease agreement with the Shelter Bay
Marina, and may be amended from time to time. Generally accepted safety
standards and requirements are applicable to all marina users and
visitors even though these guidelines are not specifically listed in
the Rules and Regulations.
Violation of these Rules and
Regulations, or other applicable Federal, State, Skagit County, and
local laws, statutes and ordinance, may lead to termination of the
Lease Agreement, eviction from the Marina, and other penalties.
Communications
Telephone
numbers for the Harbor Master and the Marina Administrator are posted
at the marina restrooms in the glass display case.
Emergencies
1. Fire -- call 911 first, describing the emergency and the dock and
slip number.
2.
Then, if it can be done SAFELY, use the Marina's portable fire
extinguishers and boat fire extinguishers on the fire. DON'T PUT
YOURSELF AT RISK! Call the Harbor Master.
3. Boats in danger of sinking -- call the Harbor Master and/or the
Marina Administrator.
4.
Oil spills or other environmental emergency -- call the Harbor Master
and/or the Marina Administrator, or 911 if they are not available.
Safety
1. No materials of any kind shall be stored on the marina floats except
in Marina-approved dock boxes.
2. Hoses, electric cords, and mooring lines across Marina main floats
are a trip hazard and should not be left unattended.
3.
All connections to marina electrical receptacles must be grounded
marine #10-3 wire which meets accepted marine wiring standards.
Improvised plugs and ungrounded connections are prohibited.
4.
Children under 12 years old are not allowed on Marina docks unless
under the direct supervision of a parent or other responsible adult.
5.
Barbecuing is prohibited on Marina docks. Cooking aboard vessels is
permitted if alcohol, diesel, electric, propane, or CNG stoves are
used. BBQ's using propane, Butane or CNG gas with safety lock
regulators may be used on board.
6. Swimming is prohibited in the Marina.
7.
Fishing from boats and docks is permitted. Bait and fish must not be
left on the docks, and all messes must be cleaned up. Fish may not be
cleaned on the docks and discarded fish parts from cleaning must not be
put into the harbor.
8. Refueling vessels from onshore sources (like a tanker truck or other
bulk delivery) is prohibited.
9.
Gasoline and other fuels, paints, varnishes and thinners and other
petroleum products, explosive and incendiary and hazardous materials,
including environmental hazards, shall not be left on docks or stored
in dock boxes. Such materials, if found unattended, may be removed and
disposed of by the Marina at the Owner's expense.
10. Battery chargers must be certified by the manufacturer as suitable
for marine use.
Environmental Protection
1.
Discharging of raw sewage into the Marina from any source and for any
reason is prohibited. Violators could have their lease terminated.
2.
No refuse or trash of any kind shall be put into or allowed to fall
into Marina waters. Please use the dumpsters on shore or carry refuse
off site. Only Marina-generated waste may be placed in the
dumpsters.
3. Used oil may be deposited in the waste oil tank on shore or
taken off site for proper disposal. No oil shall be allowed to spill
into marina waters. Any visible sheen caused by neglectful operations
shall be considered a violation.
4. Used oil filters must be drained of oil before disposal.
5.
Anti-freeze and batteries must be taken to the Skagit County Transfer
Station at 1200 Ovenell Road or other approved facility for proper
disposal as hazardous materials. Do not put these items in or next to
the Dumpsters.
6. No fuels, lubricating oil, paints and
thinners, other petroleum products, or hazardous materials may be put
in dumpsters. These products must be taken to the Skagit County
Transfer Station at 1200 Ovenell Road or other approved facility.
7.
Major repairs, such as engine overhaul, hull or superstructure
painting, remodeling, or any other work which would impose a hazard or
inconvenience to other tenants, is not permitted. Review any work with
the Harbor Master before starting if there are any questions.
Spray painting is not allowed at any time.
8.
Any repair or maintenance which causes debris or other material to fall
into the water is prohibited. Sanding or grinding dust must be confined
to the vessel using tarps or other containment technique and is not
allowed to fall into the water, or onto other boats or the dock.
Vessel Safety
1.
All boats must be moored securely, using bow, stern, and spring lines
for minimum fore and aft movement in the slip. Mooring lines must be
securely fastened to dock cleats and must be sized for adequate
strength in bad weather. Dock rings are available at some slips and may
be used as secondary tie downs, they are not strong enough to provide
for secure moorage alone.
2. Engines must not be operated in gear while boats are tied to the
dock.
3.
Marina tenants must place their names, addresses, and telephone numbers
typed or boldly printed on a 3x5 card and placed in the dockside window
near vessel's boarding area.
4. Vessels in Shelter Bay Marina shall operate at no-wake speeds.
5.
Vessels and dinghies must not be moored or rafted so as to impede the
entrance or exit of any vessel to the Marina or to a slip.
6.
Sailboats should use auxiliary engines when entering and leaving the
Marina. Sailboats do not have right of way over another vessel if under
sail.
Marina Security
1. No business or commercial operations such as chartering or
commercial fishing, may be based at the Shelter Bay Marina.
2.
If a vessel is for sale, the owner or broker must accompany prospective
purchasers to the vessel, be with them while they examine the vessel,
and escort them off the dock and back to the parking lot.
3.
Persons loitering around the docks with no purpose or relationship to
any vessel should be reported to the Harbor Master or to the Shelter
Bay Community Patrol.
4. Marina tenants shall notify the Harbor
Master or the Marina Administrator when their boats will be away from
their slips for more than 10 days. This will facilitate repair and
maintenance to the owner's slip, or allow temporary berthing for
other
vessels.
5. Guest moorage will be available to friends of
Shelter Bay residents and marina tenants at $20 per night if space is
available. $10 will be credited to the tenant whose slip is used, which
will cover any power usage. The other $10 will be applied to
administrative costs.
Tenant Conduct
1. Disorderly or
inappropriate conduct by marina tenants or their visitors, which might
injure a person, cause property damage, or disturb other tenants, is
prohibited.
2. Main engines, generators, or other
noise-producing equipment shall not be operated between the hours of
9:00 PM and 7:00 AM unless the vessel is entering or leaving the slip.
3.
Animals shall be leashed and controlled at all times while at the
marina. Animals must be tied up so they do not impede other marina
tenant's access to their boats. Animal owners shall immediately clean
up and properly dispose their animal's waste.
4. No
motor-powered vehicles may be driven on marina docks. Mopeds and
bicycles may be walked between the parking lot and the owner's boat.
5.
Permanent live-aboards are not allowed at the Shelter Bay Marina.
Owners and guests may stay aboard for ten days. Tenants who are also
Shelter Bay residents may live aboard for periods exceeding 10 days per
Shelter Bay Community rules.
6. Tenant shall notify the Marina
Administrator within 48 hours if the boat is sold, has a name or title
change, or if the tenant's address and/or telephone number changes.
Outside Contractors
1.
Marina tenants who hire outside contractors are responsible for damages
to docks, boats or other Shelter Bay Community or Company property
caused by those contractors. Marina tenants must notify the Marina
Administrator or Harbor Master when contractors will be working on
their boats in the owner's/tenant's absence. Tenants are
responsible
for notifying contractors about Shelter Bay Marina Rules and
Regulations, copies of which are available from the Marina
Administrator.
2. Noisy work on the vessel is limited to the
hours of 7:30 AM to 6:00 PM. Radios played at high volumes are not
permitted on site. Pets are to be leashed at all times or confined to
the contractor's vehicle and contractors shall immediately clean up
and
properly dispose of animal waste.
Regulations Applying Only To Non-Residents of Shelter Bay and Their
Guests and Invitees
1.
Non-resident tenants may use only those marina-related facilities, such
as the showers and restrooms, for which they have a card key or code.
The boat ramp may be used with permission of the Harbor Master of
Community Manager. Use of all other Shelter Bay facilities, such as the
swimming pools, golf course or tennis courts, is prohibited.
2.
Vehicles may only be parked in the parking lot adjacent to the Marina.
Numbered parking passes must be obtained from the Shelter Bay Community
Office and must be prominently displayed on the vehicle's rear view
mirror.
3. Non-resident tenants shall obtain card keys from the
Shelter Bay Community Office and pay a refundable damage and card key
deposit of $25. The card key is to be shown to the Shelter Bay
Community Patrol at the community gate. The deposit will be refunded
when the card is returned, providing there are no claims against it.
Wintertime in the Marina - Recommendations
Wintertime
exposes boats to severe wind and weather and low temperatures. Ice may
form in the Marina. Owners may be away, or visit their boats less often
than in the summer. Owners should prepare their boats for winter,
implementing the following precautions and taking other prudent actions
specific to their boat.
1. Replace worn or inadequate dock
lines. Boats should be secured with a minimum of two fore-and-aft
spring lines in addition to bow and stern lines. Snubbers on dock lines
are helpful to reduce fore-and-aft surging. Secure bimini tops,
dodgers, cockpit covers, and any other canvas that could blow off and
away.
2. Sailboats should secure sail covers, tie halyards away
from the mast, and remove furling jibs, or cover them with sail covers.
3. Remove dinghies from the water and store aboard or elsewhere.
Dinghies may not be stored on the dock.
4.
Marina water will be shut off sometime in the first part of November,
depending on the weather, so plan winter water needs accordingly.
Potable water is available at the marina restrooms.
5. Check
electrical cords and connections carefully. Heaters used to maintain
minimum temperatures inside boats must be suitable for boat use and
must be carefully placed to avoid starting fires. Be sure that the
heater(s) electrical load is well within the capacity of the boat's
wiring system. Overloaded wiring and direct ignition from heaters are
the leading cause of boat fires. Boat owners may be liable for damages
caused by boat fires.
6. Use great care on the docks during winter
visits. Docks and boats may be covered with ice and snow, and a slip
and fall could put the boat owner into near freezing seawater in a
largely deserted Marina.
7. Shut off fuel lines as close to the tank as possible and close
thruhulls if you will be away for an extended period of time.
